ASHLAND, Ky. (WMDJ) — A West Van Lear man arrested after police discovered suspected explosives and booby traps near Paintsville in September is now facing federal charges.
A federal grand jury indicted Robert Thomas Smith, 47, on October 22 on two counts of possessing unregistered destructive devices.
According to the indictment, the devices included a sealed plastic container containing fuel and an explosive charge connected to a fuse, and another fuel-filled container with a fireworks mortar attached.
Smith was arrested September 3 after Paintsville Police responded to a domestic disturbance near the Cross Creek subdivision along KY 40 West. Investigators reported finding suspected explosive devices inside the residence and fishing line rigged with treble hooks on a nearby hillside.
Federal court records show Smith was being held at the Big Sandy Regional Detention Center. A judge has ordered him brought before federal court in Ashland for an initial appearance and arraignment on November 18.
Each federal charge carries a maximum possible sentence of 10 years in prison.
Smith is presumed innocent unless proven guilty.
