Kentucky Temporarily Allows Untaxed Diesel on Public Roads Under Emergency Order

Category: State News

FRANKFORT, Ky. (WMDJ) — Kentucky farmers and truckers can temporarily use untaxed, red-dyed diesel fuel on public roadways following a state of emergency declaration aimed at reducing fuel costs.

Gov. Andy Beshear signed the executive order Wednesday, with Attorney General Russell Coleman granting approval later that day. The measure takes effect today, October 8.

Red-dyed diesel is typically reserved for agricultural equipment and other off-road uses because it is exempt from certain fuel taxes.

The temporary change follows a federal executive order signed by President Donald Trump earlier this week easing restrictions on the fuel's use on public highways.

Kentucky Agriculture Commissioner Jonathan Shell welcomed the decision, saying the change would provide relief to farmers facing increased expenses during the fall harvest season.

The emergency measure is scheduled to remain in effect until the emergency ends or the federal order expires December 31, whichever comes first, subject to state emergency-order limits.
