Stines Appeals Bond Denial to Kentucky Court of Appeals

WHITESBURG, Ky. (WMDJ) — Attorneys for former Letcher County Sheriff Shawn “Mickey” Stines have appealed a judge’s decision to hold him without bond while he awaits trial in the death of District Judge Kevin Mullins.

 

In a brief filed Aug. 31 with the Kentucky Court of Appeals, Stines’ attorneys argue Special Judge Christopher Cohron did not make sufficient findings to show the Commonwealth met the constitutional standard required to deny bail in a capital case.

 

The defense also argues the trial court improperly relied on video showing the shooting, claiming prosecutors did not call a witness to authenticate the recording or establish a proper foundation before it was admitted.

 

Stines’ attorneys further argue the court failed to make findings concerning his Pretrial Services Report or possible conditions of release.

 

The defense is asking the Court of Appeals to reverse the Aug. 11 order denying bond. Stines is charged with aggravated murder. The appeal remains pending.
