PIKEVILLE, Ky. (WMDJ) — A Pikeville man federally charged with child pornography is asking a judge to suppress evidence found on his cellphone.
Terry Weston Rogers, 30, argues Pikeville Police seized the phone without a warrant Feb. 25, then obtained an overly broad warrant allowing a forensic search.
The motion says the investigation began with a two-minute harassing call reported Feb. 10. Rogers’ attorney says the warrant affidavit focused only on that call and gave police no reason to search the phone for images.
The filing says an analyst could not find the call logs but discovered images in a deleted-items folder. Those images became the basis of Rogers’ federal charge.
The defense argues the warrant contained no meaningful date limit. Rogers is requesting a hearing and suppression of the cellphone evidence. Prosecutors have been ordered to respond.
No ruling has been issued. Rogers is presumed innocent unless proven guilty.
